The dissolution of a
marriage can be one of life’s most devastating events.
Behavioral research has shown that our worst decisions
are those based on emotion rather than dispassionate
analysis. The reality is that divorce forces the
participants to make critical wealth decisions in an
environment filled with high emotion. Therefore, the
chance of injurious decisions is increased.
While divorce has never
been an easy process, the changes in family structure in
our society have made the financial aspects of divorce
more challenging than ever. In those situations where
both spouses are professionals or have high-incomes,
couples face complex questions. These questions can
involve such areas as determining the value of
unexercised stock options, valuing a closely held
business, restricted or control securities, the division
of retirement plans, the control of educational savings,
complex tax implications and forensic determination of
the existence of assets. Unfortunately, most family law
attorneys lack the skills and specialized knowledge of
the financial markets that would enable them to provide
their clients with the kind of analysis needed.
In such situations,
Sweetwater acts as an advocate for our client. We seek
mutual understanding and fact based decisions that
present the client with a range of options and potential
outcomes. We work with the attorney and other advisors
to create the best possible financial solution given the
circumstances while providing the client with the
support needed to weather the process. |
